| + | I think the reason this particular story never made it into the popular folklore of our national history until 1997 (and it can be argued that it still has not) is because the court decision did not indict or attempt to dismantle the American institution of slavery. The story of the Amistad slaves was a custodial issue. The case boiled down to the fact that these Mende were illegally entered into the slave trade, and by happenstance ended up in America. No one in America had legitimate claim to them, so the Mende were allowed to be free. These Mende never participated in slave labor, and for that reason it could be said that the decision to keep these Africans out of slavery would not necessarily serve as a precedent for those African- Americans already enslaved. These slaves got justice, but due to the narrowly defined court decision the judgment did not translate into justice for other slaves. - Jason Ward | ||
