It seems that Martha Root was only the required reasoning to set argue a precedent. As is pertinent today, the issues being argued in a case can become far more important than the case itself. As I was reading Abigail Bailey's document, I noticed that it said she kicked her husband out after she found out what he was doing to one of their daughters.  Was it common back in the 1800s for women to kick their husbands out of the house for doing things like her husband was doing?
